These major offenses will get your CDL license disqualified even if you were not operating a CMV at the time of the offense. Major offenses include:

  • Driving under the influence of alcohol or drugs. Blood alcohol content (BAC) of .04 while driving CMV, or BAC of .08 while driving any other vehicle.
  • Refusing a breath or blood test.
  • Leaving the scene of an accident.
  • Using a CMV to commit a felony.
  • Causing a death while negligently using a CMV.
  • Operating a CMV without a valid CDL.

Disqualification terms for major offenses:

  • 1st offense: 1 year, 3 years if transporting hazardous materials.
  • 2nd offense: Life. Exception: DUI offenders may be eligible CDL reinstatement after 10 years if they complete approved alcohol treatment program.

Drug and Alcohol Related Offenses
